\n\t\t\t\t\t\t\t\t\t

National Convention Resolution of Sj\u00e1lfsbj\u00f6rg on Assistive Devices 2025<\/p>

The National Convention of Sj\u00e1lfsbj\u00f6rg urges the Minister of Health to present a revised and updated bill on assistive devices at the fall session of 2025, which takes into account and addresses the findings and recommendations of the working groups that have dealt with the assistive device legislation in the 2019 and 2025 reports.<\/p>

Self-Help lsh believes that the allocation of assistive devices to people with disabilities should be based on a social model of disability, so that the needs of this group for activity and participation are met, as stipulated in the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD).<\/p>

Many provisions of the SRFF address assistive devices, as their purpose is to level the playing field for people with disabilities. Article 26 of the Convention affirms the right of people to self-sufficiency, which includes the right to assistive devices for community participation in all areas of society.<\/p>

The National Assembly urges the government to cooperate across ministries and with municipalities so that a fully revised assistive device legislation best benefits assistive device users; children and adults in school, sports, leisure, free time, work, and private life. Iceland ratified the convention in 2016; it is time to implement it.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t

The National Assembly of Sj\u00e1lfsbj\u00f6rg, the National Federation of People with Disabilities, held in Reykjav\u00edk on April 26 and 27, 2024, adopted the following resolutions.\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Resolution on labor issues<\/strong><\/p>

The National Convention of Sj\u00e1lfsbj\u00f6rg calls for an immediate correction of disability benefits; the erosion of benefits (benefit cuts) by the government from before the crash to the present day must be corrected.<\/p>

It is not legal for a disability pension to be more than 100,000 kr. lower than the minimum wage, and we demand this be corrected immediately. This was supposed to be guaranteed by Article 69 of the Social Security Act, now Article 62 of the Act.<\/p>

\u201eSection 62. Annual change of amounts.<\/p>

Payments from social insurance, as well as payments pursuant to Article 42 and the amount pursuant to Article 28, shall be adjusted annually in accordance with the applicable budget. Their determination shall take into account wage development, provided that they never increase by less than the consumer price index.\u201c<\/p>

The National Convention of Sj\u00e1lfsbj\u00f6rg, the National Association for the Disabled, demands an immediate correction of these government cuts. This is money that disabled people have been deprived of despite the provisions of Article 62 of the law, as seen above.<\/p>

The National Assembly of Sj\u00e1lfsbj\u00f6rg calls for a government plan on how the government intends to act in accordance with Article 28 of the United Nations Convention on the Rights of Persons with Disabilities regarding an adequate standard of living and social protection. It states:<\/p>

\u201e"States Parties recognize the right of persons with disabilities and their families to an adequate standard of living for them, including adequate food and clothing and adequate housing, and to continuously improving living conditions, and shall take appropriate measures to ensure and promote the realization of this right without discrimination on the basis of disability.".<\/p>

We do not see that the government has ensured continuously improving living conditions for the disabled; rather, the government has systematically cut disability benefits in recent years, thereby creating significant real-terms pay cuts.<\/p>

To the government we say: "Undo the cuts and stop playing with people.".<\/p>

The National Assembly of Sj\u00e1lfsbj\u00f6rg rejects proposals for a functional ability assessment, as the organization has done under its own name and in cooperation with \u00d6B\u00cd.<\/p>

The National Convention of Sj\u00e1lfsbj\u00f6rg, the National Federation for the Disabled, urges the Althingi of Iceland to comply with its own laws, with reference to Article 62 of the Social Security Act, retroactive as applicable to the election of its own members.<\/p>

We reject the assessment of work capacity and demand a correction of the government's cuts to<\/p>

disability benefits so that they rise to equal the general wage in the labor market.<\/p>

Conclusion on the Assistive Devices Legislation<\/strong><\/p>

The National Convention of Sj\u00e1lfsbj\u00f6rg calls on the Minister of Health to present a revised and<\/p>

Analysis<\/strong><\/p>

Article 26 of the SRFF states, "States Parties shall take effective and appropriate measures \u2026 to enable persons with disabilities to attain and maintain the greatest possible independence, full physical, mental, and social abilities, including functional ability, and to participate fully in all aspects of life without discrimination."\u201e<\/p>

Many provisions of the SRFF address assistive devices, as their purpose is to level the playing field for people with disabilities. Provisions that, for example, address assistive devices include Article 4 on general obligations, Article 5 on equality and non-discrimination, Article 20 on mobility, Article 24 on education, Article 25 on health, Article 26 on habilitation and rehabilitation, Article 27 on work, Article 30 on the right to participate in cultural life, leisure, recreational, and sporting activities.<\/p>

Article 4 on general obligations states:<\/p>

g) The States Parties undertake to conduct or promote research and development of new technologies, and to ensure their availability and use, including information and communication technologies, prosthetics, equipment and assistive devices suitable for persons with disabilities, with a focus on affordable technology, Assistive Technology Resolution<\/p>

h) States Parties shall provide persons with disabilities with accessible information regarding procedural assistance, equipment, and assistive technology, including new technology, as well as other forms of assistance, support services, and equipment.<\/p>

i) States Parties undertake to enhance the training and knowledge of professionals and personnel who work with persons with disabilities on the rights recognized in the present Convention, with a view to improving the assistance and services guaranteed by those rights.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

Resolution on Assistive Technology<\/strong><\/p>

The National Convention of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, held on September 23, 2023, urges the government to revise Regulation 760\/2021 on the distribution of assistive devices in light of the provisions of the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD).<\/p>

Article 26 of the SRFF states that:<\/p>

\u201e"Member States shall take effective and appropriate measures, including through peer support, to enable persons with disabilities to acquire and maintain the greatest possible independence, full physical, mental, and social capacity, along with their ability to work, and to participate fully in all aspects of life without discrimination."\u201c<\/p>

The current regulation is too restrictive with regard to the equal right of people with disabilities to life and a good quality of life.<\/p>

The situation in Iceland today is that people with disabilities receive no support for purchasing assistive devices for leisure, training, or outdoor activities, but these are very normal parts of daily life for people in Iceland.<\/p>

The National Assembly of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, considers it necessary that, in light of the upcoming enactment of the SRFF into Icelandic law, the Icelandic government re-examine its position on grants for assistive devices.<\/p>

Resolution on parking for people with disabilities<\/strong><\/p>

The National Convention of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, held on September 23, 2023, urges authorities to tighten regulations and penalties regarding parking for people with disabilities.
Too often, parking spaces designated for people with disabilities do not meet the requirements of section 6.2.4 of the building code and are therefore unusable for people who use wheelchairs or other assistive devices. It is important to encourage companies and municipalities to comply with the standards of the building code, and if they do not, there should be some penalties, such as fines.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

It is also important to ensure that people with disabilities who live in their own homes can adapt their housing to their needs at any time without having to go into more debt than others.

In this context, the meeting resolves that a grant program or implementation fund be established by the state or local governments to assist individuals in this situation with covering costs incurred due to mobility impairment or disability.<\/p>

Resolution on labor issues
<\/b>The National Convention of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, held on September 26, 2020, calls for immediate improvements to the living conditions of people with disabilities. Representatives of people with disabilities have done all the necessary groundwork, but the issue is being held up by the government. It is unacceptable for a disability pension to be lower than unemployment benefits and more than 100,000 kr. lower than the minimum wage. People on the lowest wages can barely make ends meet, let alone disability pensioners. Cuts due to pension funds and employment income must be stopped, and the so-called "kr\u00f3na-fall" must be abolished without delay.<\/p>

Work capacity assessment<\/b>
The National Convention of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, held on September 26, 2020, calls on the government to abandon further attempts at work capacity assessments, which are only likely to cause a vulnerable group immense insecurity and anxiety about their livelihoods. We must start at the beginning by converting full-time jobs into part-time positions. In this way, none of the ministries are setting a good example, as responses to recent parliamentary inquiries prove. We urge the government to open a channel for people with disabilities into the workforce for the benefit of all.<\/p>

Resolution on the Restoration of the Disabled Persons' Implementation Fund<\/b>.
The National Assembly of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, held in Reykjav\u00edk on September 26, 2020, supports the ideas of the Association of Icelandic Municipalities regarding the reestablishment of the Disability Implementation Fund. There are far too many examples of buildings that, for instance, have elevator openings but no elevator. Such situations have, in many cases, persisted for years or decades. It was a mistake to abolish the fund, as it often resolved accessibility issues for the benefit of all.<\/p>

Resolution on the safety of people with disabilities in traffic\/vehicles.<\/b>
The National Convention of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, held in Reykjav\u00edk on September 26, 2020, urges the National Transport Authority to establish and ensure an effective regulatory framework regarding the driving and safety of individuals with disabilities in motor vehicles. Ensure in a decisive manner that the operators responsible for transporting people with disabilities comply with these regulations in all respects, and establish effective oversight for this purpose. The meeting also concludes that the knowledge and procedures for statutory inspections of specially equipped vehicles for people with disabilities must be ensured, with regard to the special equipment, its safety, and its condition. Special equipment and other modifications are often inspected little or not at all. There are examples of fatal accidents that have occurred because the safety equipment was inadequate or did not fit the person with a disability.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

Resolution on labor issues<\/b><\/p>

The National Convention of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, held on May 4, 2019, urges the Althingi of Iceland to immediately abolish the dollar-for-dollar deduction and to comply with its own laws, with reference to Article 69 of the Social Security Act, making it retroactive in this instance, as is the case with the salaries of the members of parliament themselves.
The newly approved collective bargaining agreement applies to everyone, including people with disabilities.

Article 69.<\/i><\/b>
Social security benefits, as well as payments pursuant to Article 63 and amounts pursuant to Article 22, shall be adjusted annually in accordance with the applicable budget. Their determination shall take into account wage development, provided that they never increase by less than the consumer price index. The wage development shall be used as a basis, but the consumer price index if it is more favorable.<\/i><\/p>

However, the organization points out that it is yet another humiliation for people with disabilities from the government to have to repeatedly wait for their benefit increases, many months after wages and the index have raised the incomes of other groups in society, and that this is a definite pay cut in itself.<\/p>

The National Convention of Sj\u00e1lfsbj\u00f6rg is concerned about the current situation, where the government is making it a condition that the Disabled Persons' Association of Iceland approve a work capacity assessment for a new system for disability and related payments to be implemented. The Disabled Persons' Association of Iceland has already rejected the adoption of a functional ability assessment.
For disability pensioners to be able to both improve their benefits and, where applicable, re-enter the workforce, the elimination of the current means test supplement, and thus the dollar-for-dollar reduction, is a key factor in this regard.<\/p>

Ruling on illegal residency restrictions
<\/b>The National Convention of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, held on May 4, 2019, condemns the unacceptably long time it takes to resolve illegal reductions in pension benefits for people with disabilities. The Social Security Administration and the Ministry of Welfare must take action on this matter and resolve it immediately, not in months or years as has been suggested.<\/p>

Resolution on tourism for people with disabilities.
<\/b>The National Assembly of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, held on May 4, 2019, urges the municipalities in the capital region to be careful when it comes to the new tender for transportation services for people with disabilities, both those that will participate in a joint tender for services, and if more municipalities than Hafnarfj\u00f6r\u00f0ur are going to break away and run the service on their own.<\/p>

A resolution on universal design.
<\/b>The National Convention of Sj\u00e1lfsbj\u00f6rg, the National Federation of People with Disabilities, held on May 4, 2019, believes that too much has been given away on universal design. The core principle of universal design was that when designing all structures, consideration is given to the fact that people with disabilities can live there or visit as guests. There are numerous examples where this is not the case; instead, major modifications must be made to new structures and the built environment for them to be usable by people with disabilities.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

Resolution on Travel Services for People with Disabilities
<\/b>Since a new arrangement for disabled travel services in the capital region was introduced, there has been a lack of trust from passengers toward the service. By the end of 2018, the municipalities in the capital region must demonstrate ways to implement long-awaited improvements to the planning and services of the disability transport service. It is extremely important that the municipalities answer this question to people with disabilities and their organizations as soon as possible.
According to the opinion of the Ombudsman of the Althingi, it is established that all municipalities must provide transportation services to their residents with disabilities, also in more remote areas.

The National Convention of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, held on April 21, 2018, urges those municipalities that are not already providing transportation services for people with disabilities to commit to providing them if requested, as they are mandated by law.<\/p>

Resolution on the labor rights of people with disabilities.
<\/b>The National Convention of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, held on April 21, 2018, calls on the Government of Iceland to ensure that disabled people in the country have full human rights. The "kr\u00f3na-for-kr\u00f3na" deduction is still being applied to those on disability benefits. This deduction must be abolished immediately. Disability must not be a ticket to poverty.
The organization demands that the government, municipalities, and the business community ensure the availability of part-time jobs immediately, as stipulated in the government's coalition agreement.<\/p>


A new system for disability benefits and a possible work capacity assessment will never be a bargaining chip for improved terms. The National Convention demands that the negotiations announced with disability advocates, which have not yet formally begun, proceed.<\/p>

Convention on the Rights of Persons with Disabilities of the United Nations
<\/b>The National Convention of Sj\u00e1lfsbj\u00f6rg regrets that the Protocol to the Convention has not been ratified, as it provides a complaints procedure to the United Nations that is necessary for people with disabilities.\u00a0 The government's explanation that the protocol was not ratified because it involves a transfer of sovereignty is questionable, not least in light of the fact that a resolution of the Althingi provided that the protocol was to be ratified by the end of 2017.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

Convention on the Rights of Persons with Disabilities of the United Nations
<\/b>The National Assembly of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, held in Reykjav\u00edk on May 6, 2017, urges the Government of Iceland to immediately enact the United Nations Convention on the Rights of Persons with Disabilities. The Althingi has now finally ratified the treaty, which was originally signed by representatives of the Icelandic government on March 30, 2007.
Over 160 countries of the world are now party to this important treaty. The meeting demands the ratification of the treaty before the upcoming functional assessment is implemented to ensure that such an assessment works for us and not against us.<\/p>

Resolution on the labor rights of people with disabilities.
<\/b>The National Assembly of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, held on May 6, 2017, calls on the Government of Iceland to ensure that disabled people in the country are guaranteed full human rights. Disability benefits should reflect the cost of living at all times, and the personal tax exemption should be updated according to the wage index from 1988 to the present day. The jungle of the social security system will be thinned, the system simplified, and pension reductions eliminated. The organization demands that the government, municipalities, and the business community ensure the availability of part-time jobs immediately.
Poverty should NEVER exist in our society.<\/p>

Resolution on User-Directed Personal Assistance (NPA)
<\/b>The National Assembly of Sj\u00e1lfsbj\u00f6rg, the National Federation of the Disabled, held on May 6, 2017, calls for NPA to be enacted IMMEDIATELY.<\/p>

Resolution on housing issues.<\/b>

The National Convention of Sj\u00e1lfsbj\u00f6rg, the National Federation of Disabled and Mobility-Impaired People, held on October 1, 2016, calls on the incoming government to ensure that disabled people in the country are guaranteed full human rights, that the disability pension will never be lower than the Ministry of Welfare's subsistence level, that the jungle of the social security system will be cleared, the system simplified, and all pension reductions will be reduced. We also call on the incoming government to create an incentive system so that companies see a benefit in offering part-time jobs, and for the government and local authorities to immediately set a good example of this in their own operations.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

<\/b>In the United Nations Convention on the Rights of Persons with Disabilities, the term "universal design" is defined as follows:<\/p>

Universal design means the design of products, environments, programs, and services to be usable by all people, to the greatest extent possible, without the need for adaptation or specialized design.<\/i><\/p>


<\/i>The United Nations Convention was ratified by the Icelandic government on March 30, 2007. In 2010, a new law on structures was enacted in Iceland, No. 160\/2010. It clearly states that one of the law's objectives is to ensure accessibility for all. Following the enactment of the structures law, a new building regulation, No. 112\/2012, was issued.
There has been significant pressure on the government from various stakeholders in the construction industry, including to relax accessibility requirements, and two amendments to the building code were quickly made, with a third in March 2014. Sj\u00e1lfsbj\u00f6rg lsf. has rejected all changes that compromise universal design, and although great lengths were taken to reach a compromise in the last amendment, universal design remains untouched. It has been permitted to build even smaller apartments than the previous regulations allowed. However, it was not opened up to allow for the construction of only a certain percentage of accessible apartments, for example, in each building, as had been proposed at one point. Regarding discussions among city authorities and other parties about the acute housing crisis in the capital region, it cannot be seen that universal design is to blame.<\/p>

The cost of physical therapy and assistive devices has increased dramatically, and it can be stated that a few months' pension increase goes entirely toward paying for the rise in physical therapy costs. A cap must be put on the costs that disabled people incur for various assistive devices and specialized equipment (equipment for sleep apnea, ventilators, panic alarms, etc.).
